Federal prosecutors are seeking 20-year prison sentences for the remaining defendants in the Backpage.com case, including co-founder Michael Lacey. The case focuses on accusations that the website facilitated prostitution and sex trafficking by allowing illegal ads to be posted, despite warnings. Backpage was seized by the government in April 2018, and the site was labeled a major enabler of sex trafficking.

James Larkin, Lacey’s fellow co-founder, passed away in July 2023, adding a significant turn to the legal proceedings. Despite his death, the case continues against Lacey and others. The prosecution argues that these defendants knowingly profited from criminal activity by allowing these ads to flourish on their platform.

Defense attorneys have argued that their clients were protected by free speech rights under the First Amendment and Section 230 of the Communications Decency Act, which shields online platforms from liability for user-generated content. However, prosecutors maintain that the defendants' actions crossed the line into illegal conduct.

The sentencing phase is critical, as it will address the ongoing debate over the responsibility of online platforms in regulating content that could facilitate criminal activity.

Sentencing is scheduled to take place on August 27 through 28.
