Colorado’s Gamble on Decriminalization

Decriminalizing sex in Colorado of all places is just out of the blue. You don't hear much coming out of the mountain state, but to be fair I don't go looking for much news there anyway. If you count the number of adult actresses calling it home or the somewhat odd gathering of providers not only in the Denver area but in the surrounding small towns as well, it makes more sense. Either way, with the state's bustling providers, a bill has been brought forward that would essentially let these women work in peace without the fear of being caught by LE. Some are saying it's a gateway for brothels and massage parlors to come into effect. I think we shouldn't be getting too ahead of ourselves.

On February 11th, the bill was brought up to the Colorado General Assembly. Called SB25-097, the bill was made to decriminalize adult commercial sexual activity. Now, this part is coming straight from the government website:

"The bill requires the statewide decriminalization of commercial sexual activity among consenting adults. It declares that decriminalizing commercial sexual activity among consenting adults is a matter of statewide concern and expressly preempts statutory or home rule city, town, city and county, or county ordinances, resolutions, regulations, or codes criminalizing commercial sexual activity."

hq720.jpgIt really can't get any more clear than this, but I'll break it down further for some who need it. Basically, money exchanged between two consenting adults for sex will be legal in Colorado. It wouldn't matter where in the state you are; this bill would cover the entire state. At the same time, most charges that have to do with prostitution will be dropped from a person's criminal background. When I say most charges, I mean pimping and threatening will still be against the law. However, arranging a meeting between two consenting adults will no longer be against the law. It sounds the same, but we all know there's a difference.

Not a lot of this is set in stone. This is what was brought up to the Colorado Senate and will most likely have holes poked in it to make sure a statewide decriminalization of providing isn't possible. They will most likely do what Nevada did and have providing legal in certain areas where the population isn't too vast and it can be controlled. Regardless, we all know how that worked out for Nevada, where providing has become a way of life for a lot of women, whether in the small towns the brothels are in or the big city lights of Las Vegas.

Like all bills created with decriminalization like this, consensual SWers are just part of the reason why it's being brought up. The real reason lies with an effort to help those under the age of eighteen who have been trafficked, AKA non-consensual SWers. This is also part of the reason why forced prostitution or pimping will still be labeled as a felony. If everything goes right, it's possible Colorado could be the next state to approve providing by midsummer this year.

As great as this sounds for people like us, I think reality needs to come to light. I really don't see the Colorado Senate making prostitution legal statewide. It would be a hell of a trick to do so, surpassing that of even Nevada when you think about the regulations they have over there. It's more realistic to see that if this bill does pass in Colorado, it will most likely be implemented with the same mandates that Nevada has. True, they do have more than enough senators on the bill's side to have this work, but if there's one thing I know about our government, it's that control is always key in this situation. My apologies for bringing up my ideology on our government.

I hope this works out in our favor. This would solve a lot of the problems that are occurring in our country with trafficking of children as well as criminalizing consensual SWers for something being done between two clear-minded adults. I don't think the oldest profession in the world needs to be regulated or taken advantage of, though some would think it does.
